1. General Information
For us, Mana Health Technologies GmbH, Brückenkopfgasse 1, 8020 Graz (iF Mana Health), the protection of our customers’ personal data is an important concern. This privacy policy informs you about the type, scope and purpose of the collection and processing of your personal data. The controller for data processing within the meaning of the General Data Protection Regulation (iF “GDPR”) and other national data protection laws of the member states as well as other data protection regulations is us, i.e.

2. What is personal data?
Personal data is information that relates to persons whose identity is identified or identifiable (such as name, address, date of birth, etc.).

Mana Health processes your personal data that Mana Health receives as part of the business relationship with you and that is necessary for the fulfillment of the contract or provision of services. This personal data includes the following data that Mana Health receives directly from you
– Your personal details (name, address, date of birth, e-mail address, contact details, etc)
– Your payment data (IBAN, BIC)
– Order data (e.g. payment orders)
4. For what purposes and on what legal basis is the data processed?
Mana Health processes your personal data for the following purposes:
– To carry out pre-contractual measures or to fulfill contractual obligations (Art 6 para 1 lit b GDPR) in the context of the business relationship;
– On the basis and to the extent of your given consent (Art 6 para 1 lit a GDPR), if you have given Mana Health your respective consent and
– To fulfill the legal obligations of Mana Health (Art 6 para 1 lit c GDPR).
The processing of your data serves the establishment and execution of the business relationship or the execution of the respective contract; if consent is required for processing, Mana Health will obtain it; consent is voluntary in any case. If you have given Mana Health your consent to process your personal data for specific purposes, the data will be processed on the basis of this consent in accordance with the purposes and to the extent agreed in the declaration of consent. Any consent given can be revoked at any time with effect for the future in writing or by e-mail to office@manadental.at. This does not affect the legality of the data processing carried out up to this point in time. You are not obliged to give your consent to processing.
5. Are you obliged to provide your personal data? What happens if you do not wish to do so?
Mana Health is dependent on your personal data for the business relationship and the processing of this business relationship. If you do not provide Mana Health with the relevant data, Mana Health will generally have to refuse to conclude a contract or will no longer be able to perform an existing contract and will therefore have to terminate it.
6. Will your data be passed on?
Mana Health will only pass on your data if this is necessary to achieve the purpose; within the Mana Health company, those departments or employees will receive your data who need it to fulfill contractual and/or legal obligations and/or for processing within the scope of your consent.
In order to achieve the aforementioned purposes, it may be necessary for your personal data to be disclosed to the following recipients. This disclosure may be made by transmission, dissemination or any other form of provision.
– IT companies for the provision, maintenance and support of Mana Health’s IT system and for the IT-related processing of the purpose of data processing;
– Tax consultants and accountants for the purpose and in the interest of supporting the fulfillment of Mana Health’s tax obligations (UGB, BAO, etc.);
– Marketing partners (graphic designers, advertising agencies, printers, mail order companies, telemarketing, newspaper publishers);
– Legal representatives, security authorities, competent courts or authorities for legal prosecution or tax authorities;
– Shipping service providers, in the course of processing the business relationship
It is possible that some of the recipients mentioned above are located outside your country or process your personal data there. The level of data protection in other countries may not be the same as in your country. However, Mana Health only transfers your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection or Mana Health takes measures to ensure that all recipients have an adequate level of data protection.
7. How long does Mana Health keep your personal data?
Mana Health will only store your data for as long as is necessary for the purposes for which Mana Health has collected your data. Mana Health will store your personal data in any case as long as statutory retention obligations (including UGB, BAO, etc) exist or limitation periods for potential legal claims have not yet expired.
8. Does Mana Health use decision-making based on automated processing – e.g. profiling?
Mana Health does not use automated decision-making including profiling within the meaning of Art. 22 GDPR.
9. Does Mana Health use cookies and/or other web analytics, marketing and tracking tools?
9.1Our platform uses cookies. Cookies are text files that are stored in the Internet browser or by the Internet browser on the user’s computer system, and when a user accesses a website, a cookie may be stored on the user’s operating system. This cookie contains a characteristic string of characters that enables the browser to be uniquely identified when the website is called up again.
Mana Health uses cookies for statistical purposes. Mana Health compiles general statistics in order to better design the platform according to the needs of the users; the statistics are anonymized and the individual data cannot be traced back to specific persons or IP addresses. The user data collected in this way is pseudonymized by technical precautions. It is therefore no longer possible to assign the data to the accessing user. The data is not stored together with other personal data of the user. When accessing our website, the user is informed about the use of cookies for analysis purposes and their consent to the processing of the personal data used in this context is obtained. 9.2 Legal basis for data processing with cookies
The legal basis for the processing of personal data using technically necessary cookies is Article 6(1)(f) GDPR and the legal basis for the processing of personal data using cookies for analysis purposes is Article 6(1)(a) GDPR if the user has given consent to this.
9.3 Purpose of data processing for cookies
The purpose of using technically necessary cookies is to simplify the use of websites for users. Some functions of our platform cannot be offered without the use of cookies. For these, it is necessary for the browser to be recognized even after a page change, and we require cookies for the following applications:

The user data collected by technically necessary cookies is not used to create user profiles.
Analysis cookies are used for the purpose of improving the quality of our platform and its content. 9.4 Use of web analysis, marketing and tracking tools
9.4.1 Meta Pixel (Facebook Pixel) and target group formation
Our website uses the Meta Pixel from Meta Platforms Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Meta”).
With the help of the Meta pixel, the behavior of website visitors can be tracked in order to analyze the effectiveness of advertising measures on Facebook and Instagram and to place targeted advertising (“Custom Audiences”). Data such as IP address, browser information, time and pages visited can be processed and transmitted to Meta.
The Meta pixel is used on the basis of your consent (Art. 6 (1) (a) GDPR).

9.4.2 Google Tag Manager
We use the Google Tag Manager of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.
The Tag Manager itself does not process any personal data, but facilitates the management of analysis and marketing tools. It is used on the basis of our legitimate interest (Art. 6 (1) (f) GDPR) in the efficient management of the tools used.
9.4.3 Google Analytics
Our website uses Google Analytics, a web analytics service provided by Google Ireland Limited (“Google”).
Google Analytics uses cookies that enable your use of the website to be analyzed. Among other things, the following are recorded IP address (shortened), usage behavior, end device and browser type.
Google Analytics is only used on the basis of your consent (Art. 6 para. 1 lit. a GDPR).

9.4.4 Google Ads and conversion measurement
We use Google Ads to draw attention to our offers by means of online advertising. As part of this, we use conversion measurement to analyze the success of individual advertising measures.
If you reach our website via a Google ad, a cookie is set that enables the success of our ads to be evaluated.
Processing takes place on the basis of your consent (Art. 6 para. 1 lit. a GDPR).
9.4.5 Google Ads Remarketing
Our website also uses the Google Ads remarketing feature to display targeted advertisements to visitors based on their previous interactions and behavior on other websites.

9.4.6 Windsor.ai Data Connector
We use Windsor.ai, a data integration and marketing optimization tool provided by Windsor.ai AG, Switzerland.
This tool collects and consolidates marketing and web analytics data, among other things.
Windsor.ai processes your data based on your consent (Art. 6 para. 1 lit. a GDPR).
Data may be transmitted to servers in Switzerland for optimization purposes. Switzerland is recognized by the European Commission as a country with an adequate level of data protection.
10. What Rights Do You Have Regarding the Processing of Your Data?
Under applicable law, you are entitled to:
– check whether and which personal data Mana Health processes about you and receive copies of this data;
– request the correction or completion of your personal data;
– request the deletion of your personal data;
– request the restriction of processing of your personal data;
– object to the processing of your personal data;
– request data portability; and
– know the identity of third parties to whom your personal data has been transferred.
If Mana Health processes your data based on your consent, you have the right to withdraw that consent at any time by emailing office@manadental.at or by sending a letter to Mana Health Technologies GmbH, Brückenkopfgasse 1, 8020 Graz, Austria. This withdrawal does not affect the lawfulness of the processing carried out prior to the withdrawal.
You may also withdraw your consent for analytics, marketing, and tracking tools at any time with future effect by adjusting your preferences in the consent management tool (cookie banner) used on our website.
Withdrawing your consent does not affect the legality of data processing carried out before the withdrawal.
In addition, you have the right to lodge a complaint with the Austrian Data Protection Authority or another data protection supervisory authority in the EU, particularly in your country of residence or place of work.
